(henceforth , the ‘Ts&Cs’)

(henceforth ‘Carethy’, ‘We’ or ‘Us’) is a Spanish company, with CIF B-67129486 and registered in the Public Registry of Commerce of Barcelona (SPAIN) in the Volume 42226, Page 39, Paper B-404814, Registration 1st and with direction Calle Monturiol 28, 08210, Barberá del Vallés (Barcelona). 1.- SUBJECT AND GENERALITIES

 

1.1.- Carethy is owner of the web page www.carethy.es (henceforth, the ‘Website’), which is a web platform on which are commercialised general consumption products.

 

1.2.- The Ts&Cs described below regulate the conditions of use and access to the Website by any user (henceforth, ‘Users’) and the purchase of products that offers Carethy on the Website (henceforth, ‘Product’ or ‘Products’) for any User through the Website (henceforth, ‘Customer’).

 

1.3.- The Users of the Website, to obtain the status of Customers and therefore, obtain the Products, will have to fill out an identification and registration form, accepting the present Ts&Cs and all of that following the indications that they will receive through the Website itself.

 

1.4.- Carethy operates and realises shipments to 139 countries around the world (henceforth, the ‘Territory’). Each country takes part of a group of countries, which are the following: Spain, Main EU, ROE, EEUU (USA) and ROW. To consult the group of countries to which the CUstomer placing the order belongs, please consult the following link. 


1.5- The group called Spain realises shippings on all the Spanish territory including the Iberian Peninsula and Balearic Islands, with the exception of Canary Islands, Ceuta and Melilla

 

2.- USES OF THE WEBSITE

 

2.1.- The Customer and User of Carethy commit to make an appropriate and legal use of the Website, in approval with the applicable law and the present Ts&Cs.

 

2.2.- It is forbidden to make an unfair or incorrect use of the Website. The Customer and/or User will have to abstain from doing, among others:

a) Commit offences, or incite others to do so.
b) Introduce or spread out any cyber virus on the network, post offensive or obscene material.
c) Hack any aspect of the service of the Website.
d) Corrupt data appearing on the Website.
e) Send unwanted advertising or promotional material (“spam”).

 

2.3.- Carethy will not be liable if the Website is not available at any moment.

 

2.4.- The Website too can contain links to other websites that are not operated by Carethy (henceforth ‘Other Websites’). Carethy does not exercise any control over Other Websites and is not liable for their content or any harm they could produce for their use. Although it reserves the right to remove those aforementioned links if by any way they would be known being on the Website and committing any irregularity or illegality. 

 

3.- ACCEPTANCE, MODIFICATION AND DURATION OF THE GENERAL CONDITIONS

 

3.1.- The use and access to the Website by the User entails the present Ts&Cs’ acceptance. Additionally, to be able to obtain some of the Products offered by Carethy, it is mandatory that the Users fill out a form entirely with their identification data accepting expressly the present Ts&Cs and the Privacy and Cookies Politics. If the User has any doubt regarding the Ts&Cs, they can contact the Company using the Identification Data named in the present Ts&Cs.

By placing an order for Products from the Website, theCustomer accepts the complete and total acceptance of these General Contract Conditions, the knowledge of which prior to placing the order is acknowledged by the Customer.

 

3.2.- Carethy reserves the right to modify at any moment the content of the Ts&Cs. In any case this will affect the Customer or the User, that will be subject to the prevailing Website Ts&Cs at the moment of the Products purchase or at the moment of use and access.

 

3.3.- The legal relationship produced by the access and use of the Website has an indefinite duration. Without prejudice to the prior. any of the parts will be able to end the contractual relationship whenever they wish to. In the case that Carethy modifies the Ts&Cs, this legal relationship will stay solved and will imply that the Customer or the User will have to adhere to the new Ts&Cs, in that case.

 

3.4.- The contract shall legalise in any of the languages available the Ts&Cs in the Website, at the choice of the Customer.  

 

4.- OBLIGATIONS OF CARETHY AND THE CUSTOMER/USER

 

4.1.- Carethy commits to leave at its disposal to the Customer and/or User all the necessary information relative to the Products it offers as well as the one of the orders realised. Carethy does not take responsibility for the non temporal compliance of the present Ts&Cs in case of force majeure and in case of offence from the Customer or of an unpredictable event from a person external to the contract.

 

4.2.- The Customer and/or User commit to fill out the order formers and any other form, according to the instructions indicated and with truthfulness. The Customer also commits to pay the price of the Product, with all the taxes corresponding and the shipping costs always agreeing with the final offer received from Carethy.

 

4.3.- We advise you to keep a copy of the data related to the Products purchased. 

Carethy does not take responsibility for the consequences and damages produced from the loss of the information indicated by the Customer. 

 

4.4.- Carethy does not take responsibility for the consequences and damages that could result from an unsuitable use of the Products sold through the Website.

 

5.- INFORMATION ON THE PRODUCTS

 

5.1.- Carethy offers a detailed description of the Products included on the Website agreeing with the technical descriptions coming from the distributors, manufacturers and providers in general. Likewise, it includes the information related to the commercial name, brands or distinctive signs of the Products to give the maximum of information possible to the Customer and/or User. These aforementioned description can include photographies, videos or illustrations that can hold an indicative nature but in any case exhaustive and therefore, Varethy does not take responsibility for the mistakes that could derive from them.

 

5.2.- The offers published on the Website include a detailed description of their conditions, including their duration, amount of available units, price as the information relative to the Product offered.

 

5.3.- Read thoroughly the descriptions of the Products before deciding to purchase them. If you have any doubt, contact us before realising the purchase.


6.- PLACE AN ORDER

 

6.1.- To be able to make an order, the Customer will have to be aged of at least 18 years old and reside on the Territory.

 

6.2.- The User will be able to register on the Website, in the section ‘Create account’. For this, they will have to introduce personal information required as mandatory. This registration will provide the User with access to the webpage and to the purchase of products.

 

6.3.- The realisation of the order includes the selection of one or various articles and to press the button ‘Add to my cart’ that will be attached to ‘My shopping cart’ of the virtual purchase. Once added all the articles wanted to the shopping cart, it is required to access to the latter, revise the articles and the amount of units, select the type of transport wanted and press ‘Proceed to purchase’. Subsequently, the User will get to choose between ‘Buy as a Guest’ (if they have not registered previously on the Website) where they will have to fill out their personal information, shipping information and complete the information corresponding to the payment method, or, the User will also be able to make the purchase process by pressing ‘Go to my account’ where they will not have to fill out again their personal information. In both cases, when pressing the button ‘Buy now’, the purchase process will be formalised.

 

6.4.- All the orders are subject to our acceptance. Within 24 hours following the realisation of the purchase, we will send our confirmation by email that the purchase has been held (henceforth, ‘Order confirmation’), every time the Customer has provided us with the direction of their email in their personal information form. Carethy does not take responsibility for the mistakes and the non effectiveness of the email direction given by the Customer and/or User for the delivery of the Order Confirmation.

 

7.- ORDER CANCELLATION AND MODIFICATION

 

7.1.- Cancellation, the amount will be refunded through the same payment method used. The amount to be returned will be reimbursed within a maximum period of 14 days from the day the notification is registered.

7.2.- Extension of the order. Items can be added to an order as long as it has not been shipped and logistically possible. The client will pay the amount corresponding to the result of the modification.

7.3.- Elimination of articles. Items can be removed from an order as long as it has not been shipped and logistically possible. The refund of the money will be made through the same payment method used.

In the case of modifications in the order, it can result in a modification of the total cost, which is subject to an extra charge of shipping costs in the case the minimum purchase amount stipulated would not be reached, as well as the elimination of the aforementioned costs if the total cost is equal or superior to the minimum purchase amount indicated on the webpage.


 7.4.- Return of articles. Products can be returned within 14 days from the day of receipt. Before making any return, you should contact our Customer Service to communicate it and to receive help in the process. Upon receiving the returned merchandise and checking its good condition, the amount will be refunded within 14 days after the verification of the products. The products must be in their original state and the returns sheet correctly filled out.

In order to make a return, the customer must bear the costs of returning the product. In the event that the return is due to a damaged product or due to the delivery of an erroneous product, our Customer Service Department should be contacted immediately.

Any claim made after 14 days from the delivery date cannot be addressed.


8.- AVAILABILITY

 

The orders are subject to the availability of the Product from our providers.

It can happen that those Products are not in stock or have been damaged, or do not have the expected quality, among others. In these cases, the customer will be informed and an offer of alternative products will be made, or the aforementioned order will be cancelled. The resulting cost will be refunded in a maximum period of 14 days. The refund of these quantities will be the limit of our responsibility before the Customer, if it would be impossible to deliver them the Products requested.

 

9.- PRICES

 

9.1.- The prices of the Products indicated on the Website include the applicable VAT according to the law in force at the moment of the purchase, but not the shipping costs. The price of the products varies dynamically in order to follow the evolution of the market and thus be able to publish the best offers on our site. At the time of purchase, the customer assumes the price of the product, therefore possible price variations are not refundable.

 

9.2.- The shipping costs run for the account of the Customer, unless otherwise specified, and are defined during the purchase process, being detailed separately to the price of the Product. Although, once they are known exactly, the User can cancel at no cost any item of the purchase. The sum of the shipping costs and the cost of the Product will be the total price to pay which will be shown to the Customer before the formalisation of the purchase.

 

9.3.- In the purchase process the Customer will accept the total price when pressing the button ‘Buy now’.

 

9.4.- We keep the right to charge the order from the Order Confirmation.

  

10.- PAYMENT OF THE PRODUCTS


10.1.- Carethy leaves at the disposal of the Customer four payment methods: 

 

- Payment with credit/debit card:

If they opt for the payment by card, the Customer order will not be processed until the payment has been authorised by their bank. The online payment by credit card will be made through the security system ‘Secure Socket Layer’, which encrypts the banking data once transmitted by internet. For security reasons, Carethy verifies all the orders paid by banking card. We accept cards from American Express, Maestro and any Visa and Mastercard registered in the verified payment system Verified by Visa. Moreover, for any order which amount would be superior to a pricelist set by Carethy, the Customer will be asked an identity document they will have to send us at the email indicated in our contact information. 

 

- Payment by banking transfer: 

The Customer will have to realise the transfer to the account that they will be duly informed. When finalising the order, the Customer will receive an automatic email with the details of the banking account on which the deposit will be made. As reference of the banking transfer they will have to indicate the reference that will be mentioned when finalising the purchase. In case they would not indicate that reference, the order will be canceled and its refund will be made in a maximum period of 14 calendar days. This method of payment has an additional cost of 2.95€ (currency according to change).

 

- Payment by PayPal:

Paypal enables to pay directly without communicating the financial data on the Internet. It automatically codifies the confidential data with the help of the best technology available on the market. This method of payment has an additional cost of 2.50€ (currency according to change).

- Points:

The points are balance issued by Carethy that the User will receive promotionally after different possible actions and that they can only be used on the Website. They can be used in one or more purchases until the amount of the same is completed. In case of not reaching the total amount of the order, the payment may be completed with another form of payment of those mentioned above. In the event of the return of Products purchased with points, the refund of the amount will be made through an increase in said points available in the Customer account on the Website. Points are personal, non-transferable and cannot be exchanged for cash.

 

10.2.- Carethy has contracted the services of Stripe Payments Europe, Ltd, and Irish company, company offering a safe online payment bridge, so that the information provided by the Customer at the moment of the payment will be processed by this company and therefore Carethy will not have access and will not save any of this information. 

 

10.3.- In the case the purchase would have been done by a final consumer or a company, the corresponding invoice can be requested. It has to be requested through the contact section of the webpage, once the order received, specifying the billing data. The customer authorises us that we send the invoice on the electronic support, even though they can ask that we send the invoice on paper si they wish at no cost.


 

11.- DELIVERY OF THE PRODUCTS

 

11.1.- Carethy will deliver the Products to the Customer at the delivery direction that appears on the personal data form provided by the Customer themselves, which will have to be within the limits of the Territory.

 

11.2.- We understand the days as working days, excluding in this way saturdays and sundays and bank holidays. If for any reason imputable to Carethy this period would be surpassed, we will communicate the incident to the Customer and offer them alternative solutions.

 

11.3.- The estimated delivery date will be the one indicated on the webpage, on each Product datasheet. This date is illustrative as it can vary according the Product disponibility, just as the transport service chosen. This date can also be seen modified in case of the existence of an incidence with the stock of the products or with the transport service. In any of these cases, a solution will be sought for the Customer.

 

11.4.- The shipping cost is specified at the purchase moment or once applied the discounts (points-vouchers-campaigns and promotions). Once the payment made, it is not possible to modify the transport service.  

 

11.5.- The Customer commits that themself or another appointed person are present in the dwelling indicated to receive the parcel. In case there would be no one the first time, the transportist will insist one more time. If the order could still not be delivered, it will be sent back to us, with the consequent refund of the Customer of the payment made minus the returning costs of the Products that will be charged to the Customer, as well as the ones of a second shipment if it occurs.

 

11.6.- In any case, the delivery will be made in a maximum period of 30 days from the execution of the contract, except for exceptions expressly informed at the time of purchase. 

 

11.7.- The Products’ risk will be transmitted at the moment the Customer will acquire the material possession of the Product. 

 

11.8.- The Customer acquires the propriety of the Products once Carethy receives the total payment for the order placed.


11.9.- The cost of Customs will be borne by the customer, since they are taxes from the receiving country and these costs are not linked to our sales service. 


11.9.1.- Only for Mexico Country: Once the order is in transit, it is waived to request a refund. Carethy is not responsible for the customs actions of each country.  


11.9.2.- Only for Colombia Country: The customer agrees to waive the possibility of requesting refunds for delays, losses or damages generated during the transport of the merchandise. Carethy is not responsible for the customs actions of each country.  


11.9.3.- Only for Brazil Country: The customer agrees to waive the possibility of requesting refunds for delays, losses or damages generated during the transport of the merchandise. Carethy is not responsible for the possible additional fees generated in  customs as well as the customs actions of each country according to current tax legislation.   

11.10 - Carethy makes available to Clients who live near our logistics facilities the possibility of picking up their order at no cost (€ 0 shipping costs). To pick up the package at the store, the Customer must go to Calle Monturiol 28, 08210, Barberá del Vallés (Barcelona), have a valid identity document and the Order number that appears in the confirmation email.

At the time of delivery of the package, the Customer must sign the delivery note. This document is the proof of delivery by Carethy and the receipt by the Customer. No dispute related to the delivery itself is possible if this document is completed and signed.




 

12.- GUARANTEE OF THE PRODUCTS

 

12.1.- All the Products offered by Carethy have the guarantee legally expected. We commit to replace by a new one or realise the corresponding refund if any of the Products would suffer from a manufacturing defect, in a period of two (2) years after the delivery of the Product, although the proof of the defect will have to be done according to the procedure of the section 12.5. In this case, all the refund expenses of the Product or the same fixed one are at the charge of Carethy.

 

12.2.- Except proof of the contrary, the delivery is considered done the day it appears on the invoice or on the delivery note if it would be subsequent.

 

12.3.- To make the guarantee effective, the proof of purchase will need to be presented within the legal period established. 

 

12.4.- The consumer will have to inform us of the non-conformity of the Product in the period of 2 months after they acknowledged it by email or phone using the information facilitated on the section of the Identification Data in the present General Conditions.

 

12.5.- Except proof of the contrary, it will be presumed that the lacks of conformity appearing in the six months after the delivery of the Product already existed when the thing was delivered, except if this presumption would be incompatible with the nature of the Product or the kind of non-conformity. From the sixth month we will proceed in the same way, so that there will be no presumption that the product would have suffered from any defect, as it should have to that extreme be tested by the User and/or Customer.

 

12.6.- There is conformity of the Products with the contract so that Carethy will not be responsible for the lacks of conformity when the Products appearing on the Website:

a) Fit with the description released by the seller and have the qualities of the Product the seller presented.

b) Fit with the uses usually assigned to the Products of the same kind.

c) Fit with any particular use required by the consumer or user when they have acknowledged the seller at the moment of the execution of the contract.

d) Present the quality and the usual features of a Product of the same kind as the consumer and user could expect with grounds, taking into account the nature of the Product.

e) The products will meet the requirements of current Spanish legislation. Carethy will not assume any responsibility in the event of non-compliance with the legislation of a country other than Spain where the Product will be delivered. It is up to the Customer to verify that the Products are within the applicable limits for importing and using the Products purchased.

 

12.7.- Likewise, Carethy will not answer to the lacks of conformity that the Customer would know or could not have been able to ignore at the moment of the execution of the contract.

 

12.8.- The Customer will be able to require the repair of the Product, its replacement, a price reduction or the resolution of the contract if the Product would not comply with the contract. The reparation and replacement will be free for the Customer, this includes the delivery costs and the costs related with the labour and materials. In the case the Customer exercises their right for a repair or replacement, Carethy will deliver a receipt with the delivery date and the lack of conformity caused by the exercise of this right. The refund or replacement of the Product will be made as quickly as possible and, in any other case, before the 14 days following the day Carethy contacted the Customer to confirm the refund process or the replacement of the Product not conformed.

 

12.9.- The price reduction will be proportional to the difference between the value the Product would have had at the moment of the delivery. The Customer will not be able to require the replacement in the case of unperishable products.

 

12.10.- The guarantee does not include the damages produced by negligence, blows, use or undue manipulations, unappropriate tensions, electrical accidents, installation and/or utilisation not conformed with the instructions of use or not realised by the authorised technical service when proceeding, or perishable materials or products, subject to wear and tear due to normal or consumable use. Likewise, Carethy will not answer to lacks of conformity the User would know or could have not ignored at the moment of the execution of the contract.

 

12.11.- Stayed excluded from the guarantee:  
a) Those Products modified or fixed by the Customer or by any other person than the supplier or manufacturer. 
b) If the data from the Product guarantee or the proof of purchase was modified.
c) Goods that can deteriorate or expire quickly.
d) Any other good if the Customer does not possess the proof of purchase.


13.- THE RIGHT OF WITHDRAWAL AND TO CHANGE THE PRODUCTS

 

13.1.- Right of withdrawal. The Customer has the right to withdraw from this contract within a period of fourteen (14) calendar days with no justification

 

The withdrawal period will expire fourteen (14) calendar days after the Customer or a third party indicated by the Customer, other than the carrier, acquired material possession of the products, or in the event that the Customer's order consists of several products delivered separately, fourteen (14) calendar days after the Customer or a third party indicated by the Customer, other than the carrier, acquired material possession of the last of those products.

 

13.2.- Notifications. The Customer can exercise the right of withdrawal by notifying Carethy E-Commerce S.L. at the Calle Monturiol 28, 08210, Barberá del Vallés (Barcelona), phone number+34 93.396.71.72 extension 100, communicating their decision to withdraw from the contract through an unequivocal statement. They may electronically fill out and send us the withdrawal form that appears as an Annex to these General Conditions, although its use is not mandatory, or make any other unequivocal statement through an e-mail to: [email protected] or by accessing the 'Contact' section of the Website. If they make use of this option, we will inform them without delay on a hard-wearing medium (like by e-mail) of the receipt of such withdrawal.

 

In order to comply with the withdrawal period, it is enough that the communication relating to the exercise of this right by the Customer is sent before the expiry of the corresponding period.

 

13.3.- Consequences of the withdrawal. In case of withdrawal by the Customer, we will refund them all the payments received from them, including the shipping costs (with the exception of all the additional costs resulting from the selection by the Customer of a shipping method different from the cheapest usual delivery method we offer) without any undue delay, and in any case, 14 calendar days to the latest, from the date we are acknowledged of the customer’s decision to withdraw from the present contract. We will proceed to execute the aforementioned refund using the same payment method used by the Customer for the initial transaction. No expenses will incur as a consequence of the refund. Despite the former, we will be able to withhold the refund until having received the goods, or until the Customer would have presented a proof of refund of those, as per the condition is met first. 

 

The Customer will have to return us the Products to Carethy E-Commerce S.L. at the address Calle Monturiol 28, 08210, Barberá del Vallés (Barcelona), with no undue delay and, in any case, in a period of 14 calendar days at the latest from the date the Customer informs us their decision to withdraw from the contract. The period will be considered fulfilled if the return of the goods is realised before the end of that aforementioned period. 

 

The Customer will have to assume the direct cost of the return of the goods and only the Customer will be responsible for the goods value reduction resulting from a distinct manipulation to the necessary one to establish the nature, characteristics and functioning of the goods.

 

13.4.- How to return the Product.. In order to make a correct return of Products, it will be necessary to follow the steps mentioned below:

 a) Customer Service must be contacted through the contact form on the Website [link https://www.carethy.co.uk/contact]

 b) With the return document provided by the Customer Service, duly printed and completed, we will proceed with the corresponding return, including it in the package to be returned to our facilities.

 c) The Products must be returned in their original box / packaging. If this is not possible, please use a box of the same quality.

 d) The Products may not have been used in such a way that their value is reduced or impaired.

 e) Upon arrival at our warehouse, the status of the Products will be assessed. If they do not comply with the regulations and conditions established for returns and their condition is not correct, we reserve the right to pay a lower amount for the damaged Product/s.

 

13.5.- Products excluded from the withdrawal right. Stay excluded from the withdrawal right alimentation, beverage, cleaning and personal hygiene Products. Likewise, will stay excluded:

a) Personalised goods. 
b) Goods that can worsen or expire quickly. 
c) Pre-sealed goods not suitable to be returned for health or hygiene protection reasons and that have been unsealed after the delivery.


 14.- COMMENTS

All the opinions written by Customers are controlled by the marketing team. If the opinions received break or could break the law, ethics, or moral (abusive advertisement, defamation, insults, out-of-context comments…), Carethy reserves the right to reject or remove those opinions.

 

15.- PERSONAL DATA PROTECTION

15.1.- We inform you our Customer personal data will be treated in accordance with the principles of transparency, limitation of purpose, data minimisation, accuracy, integrity and confidentiality, as well as respecting the rest of the obligations and guarantees established in the Regulations (EU) 2016/679 of the European Parliament and the Council of April 27th, 2016 regarding the protection of natural persons and on the grounds of the following:

We treat the information you facilitate us with the end of provide you the requested service and realise its billing, provide customer service and send you communications relative to the acquired products or similar ones. 

 c) What is the origin of your data and which data categories are we treating?

The personal data we will treat are the identifying data you facilitate us through the registering form in our Webpage.

 d) For how long will we keep your data?

The data generated will be kept as long as the contractual relation is maintained or during the years necessary to meet the legal requirements. 

 e) What is the law regarding your data treatment? 

The legal basis allowing us to treat your personal data depends on the purpose for which we are treating it and would be the following: the contract execution, as we consider we have a legitimate interest, to comply with a legal obligation and because we have your consent.

 f) Will we share your data with third parties? 

The data you facilitate us will not be given to third parties except in cases of legal obligation. Even though, to carry out determined functions necessary for the service provision, your data can be treated by third parties that will act as responsible for the treatment and that will be obliged to comply contractually with the legal obligations of treatment manager, to maintain the confidentiality and secret of the information.

 g) International transfers of your data:

We inform you that some of our service providers mentioned in the previous section as treatment managers can be located outside the European Economic Area (‘EEA’). However, we guarantee an appropriate level of personal data protection.

 h) Rights: you are the title holder of the following rights regarding your personal data: 

- Right to request the access to your personal data.

- Right to request its rectification.

- Right to request its elimination.

- Right to request its limitation.

- Right to request the opposition to its treatment.

- Right to the data portability.

- Revocation of the given consent. 

- Right not to be object of individualised decisions.

16.- INDUSTRIAL AND INTELLECTUAL PROPERTY

16.1.- ‘Carethy’ and ‘Biuky’, are brands registered at the European Union Intellectual Property Office. Therefore, any use of these names or any similar identifying sign that could engender confusion about its origin or ownership by others without previous expressive authorisation is prohibited.
